i am buying a USED ipod touch, its still in good condition. but i was curious whether or not, hypothetically, that i can bring it to the genius bar if it breaks.

Technically speaking, you shouldn't have a problem with this since the iPod touch hasn't been out long enough to be out of warranty yet, so in most cases the Genius Bar probably won't even bother to ask for a receipt.
Although the warranty is technically one year from the date of purchase, in the absence of any other information, Apple tracks warranty based on the date of manufacture of the device. If at all possible, try to get the original purchase receipt from the person you're buying it from so that you can prove the actual purchase date (the warranty extends from the date of original purchase, not from the date that you purchased it second-hand).
You can confirm the warranty expiry date based on a device's serial number by going to www.apple.com/support and selecting the "Check My Warranty and Repair Options" down near the bottom-right corner. =============
