Some advice please.
I have hearing at county court 30th of this month. Court ordered both parties couple of months ago to send all documents both parties want to present during hearing to each other and to the court not later than 14 days prior to hearing. Last day is today I think.
I have sent all as special delivery, received by court but not by defendant (fair chances that he has left the premises). However I have not received anything from defendant.
Any idea what should be next? =============
Attend the hearing.
Don't think that a lack of response from the other party means that they won't turn up at the hearing. However, because they have not made disclosure then the judge may not allow them to present any evidence in their defence. =============
Provided that you have served at the correct service address given by the Defendant you will be OK. If the Defendant has not received your documents the Defendant may ask the Court for more time but this is at the discretion of the Court taking into account the Defendant's behaviour to date.
Do attend the hearing, or send a Statement of Case if you cannot attend (Court must receive this 7-days prior to hearing) =============
